Contracts with Receiving Organisation
UTS has insurance cover for academic activities of this nature provided the activity has been approved by the Faculty, Institute or School concerned as being consistent with your course objectives.
The Public Liability Policy covers the negligent actions of an enrolled student which may cause either injury to others or damage to property owned by others, provided the student was not acting as a paid employee of the receiving organisation.
- Download the relevant indemnity form
- Complete the form and have it authorised by your faculty/division.
- Faculty Managers/Administrators and Program Directors may download the master copy of the Public Liability and Personal Accident certificate of currency.
- Give the student copy of the approved indemnity form plus the certificates to be taken to the receiving organisation.
- A copy of the approved indemnity form should be kept at the faculty/division for records in case a claim arises.
Record Keeping Requirements:
Each faculty/unit needs to keep records outlining:
- Full details of the activity
- Period of the event
- Student details(name, student number)
- Records are kept locally
- Records are completed and filed before the event
- Records should be made available to Tax and Insurance Section if a claim arises.
- If a claim arises due to personal accident complete the AIG accident and sickness report form.
- Attach a copy of the approved indemnity form
- Attach all supporting documents for the loss claimed.
- Submit the form to the Taxation & Insurance Officer.
If a student receives any form of gratuity or reward for the community placement or professional practice undertaken, then the University insurance program will not extend to that student.
In a paid employment situation, as an employee of a receiving organisation, the student should be covered by the organisation’s workers’ compensation and public liability insurance.
“Industrial scholarships” may not necessarily be “paid employment” and Program Directors should clarify the insurance status of the student with the receiving organisation.
Students undertaking professional practice or community experience as a course/subject requirement and/or to gain experience in their field of study are covered by the University's Public Liability and Personal Accident Insurance. This cover does not extend to incidents involving motor vehicles.
A student and voluntary worker Personal Accident Policy provides a capital benefit for death and a proportionate amount for permanent disability such as loss of sight, loss of hearing, burns, paralysis/loss of use of limbs or parts thereof and loss of income (if an income earner) to prescribed amounts. Medical expenses payable by Medicare or classified as “Medicare gap” are not covered.
Your personal property is not covered by the University’s Insurance at any time. If you wish to arrange cover for personal items you must do so at your own expense.
Faculty Managers/Administrators and Program Directors may download certificate of currency for public liability and personal accident.
Agreements should be carefully reviewed for indemnity and hold harmless clauses (and similar) which seek to limit the liabilities of the receiving organisation or which seek to have the student waive any rights against the receiving organisation.
Students should be entitled to exercise rights against a party causing injury or loss. Students should not waive their rights purely for the convenience of securing work experience or entry to a site.
UTS will not stand in the place of the receiving organisation. We are not insured for liabilities assumed under contract if those liabilities would not attach to UTS in the normal course of events. Liabilities assumed under contract may become an uninsured commercial liability for the Faculty, Institute or School concerned.
Any specific insurance requirements of the receiving organisation may be forwarded to UTS Insurance for review, comment and advice before the contract is executed.
UTS INDEMNITY FORMS
UTS provides “Indemnity Forms” to students as a matter of course. The indemnity form does not limit the obligations/liabilities of the receiving organisation, nor does it increase our liabilities/obligations.
The “Indemnity Forms” may be authorised by the Faculty/Institute/School concerned, provided adequate records are maintained. These records may be required in the event of litigation and they should be retained for seven years. Importantly these records should be obtained prior to the activity.
They should include:
- Name and number of the student;
- Name and address of the receiving organisation;
- Site address;
- Names of all voluntary workers participating in the student’s project;
- Approximate or actual date/s of the site visit/s or work experience or similar activity.
A separate Indemnity form is provided for use when a student finds it essential for a child to be present at a site visit. UTS prefers that children do not accompany students on site visits.
